Rules Adopted

On October 24, 2018, the LMRWD adopted its state-approved Watershed Management Plan (Plan). The Plan established management standards that form the foundation of the LMRWD’s rules. Rules were developed because they are required by Minnesota Statute 103D and to provide a legal basis for the LMRWD to regulate projects not regulated by municipalities (e.g., unincorporated areas and MnDOT rights-of-way).

On February 19, 2020, the LMRWD Board of Managers adopted rules to govern soil erosion and sediment control, floodplain and drainage alteration, stormwater management, and development on steep slopes within the boundaries of the LMRWD. These new rules will become effective on May 1, 2020 and were adopted to protect the public’s health and welfare, as well as the natural resources of the LMRWD, and are enforceable under Minnesota Statute.

Two seperate permits

During the rules development process, two separate permits were created, the Municipal (LGU) Permit and the Individual Project Permit. The Municipal (LGU) Permit allows local municipalities to issue permits and manage actions as the primary permitting authority and allows the LMRWD to act in the event the LGUs are unable to permit. The Individual Project Permit allows the LMRWD to act as regulatory body in those areas not regulated by a municipality. These include unincorporated and ungoverned areas of the Fort Snelling Historic District and on MnDOT right-of-way.
